Як, знаходячись в глухому українському селі, де 48 душ і одна корова, опинитися під санкціями міністерства фінансів США? або Вам так не буде...

— В Нью-Йорке особенно остро понимаешь, что можно провести всю жизнь на какой-нибудь маленькой вонючей кухне, глядя в обосранный грязный двор и жуя дрянную котлету. Будешь вот так стоять у окна, глядеть на это говно и помойки, а жизнь незаметно пройдет.

— Интересно, — задумчиво отозвался Татарский, — а зачем для этого ехать в Нью-Йорк? Разве…

Це уривок з роману російського письменника Пєлєвіна “Generation “П”, який був написаний ще у 1999 році. 

Зараз, коли московія вже котрий рік поспіль веде нищівну війну проти України, здається мені, що за порєбріком у москалів нічого не змінилось. Можливо й від того вони і підтримують пуйла, що досі жують погані котлети у маленькій смердючій кухні дивлячись в обісраний двір. Та тягнуть пральні машинки, унітази, брудну жіночу білизну своїм жінкам...

На відміну від українців, про яких відомий митець Іван Семесюк якось сказав:

“Українці – це такі Наддніпрянські агроельфи, які кінець кінцем всіх переможуть, заллють бетоном і посадять зверху кущ калини”.

Але ж до чого тут мінфін США, москалі та агроельфи? А справа тут проста — у здоровому глузді, бажанні жити за законом і НЕбажанні їсти погані котлети... які все так настирливо пруть сюди кацапи з “руським міром”.

В Сполучених штатах, свого часу, народ домовився між собою - уклав, так би мовити, суспільний договір про те, як вони будуть жити: про верховенство права, приватну власність, свободу слова та інші основні засади існування цивілізованого суспільства.

Так ось, коли ми навесні оселились як переселенці в селі на вінничині, то вирішив (не питайте навіщо і т.ін.; вирішив та й усе) створити інформаційно-новинний сайт міста, бо в інтернеті не знайшов таких. Придумав назву доменного ім’я та зареєстрував його в зоні “.today”

Через деякий час домен запрацював, почав його потроху налагоджувати і т.ін. Але виникла необхідність повернутися додому по документи. Поїхав. А в цей час на електронну скриньку надійшов лист від реєстратора домену, який я своєчасно і не прочитав.

Минуло більше місяця, вже давно повернувся і займаюсь іншими справами, але весь цей час домен вже не знаходився в мережі і вся ця історія мене періодично муляла — чому не робе, все начебто прописано так, як треба... Вже і декілька разів звертався до служби підтримки реєстратора — все без якогось результату. Тут не витримав та взявся за справу шільно.

Спершу знайшов того листа від реєстратора:

Dear Registrant, 

Kindly note that your domain name “***.today” has been flagged by the Registry "Donuts Inc". As they are a US owned company, they are not permitted to provide services to, nor engage in any transactions with countries, regions, entities, or individuals targeted by applicable US trade sanctions (OFAC listings), whether directly or indirectly, unless authorized under applicable laws. Acknowledging these obligations, the Registry carries out a regular comprehensive review of all registrations in their zone. 

Pursuant to Section 3.6.5 of the RRA, Donuts reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, that it deems necessary, in its discretion; (1) to protect the integrity and stability of the registry; (2) to comply with any applicable laws, government rules or requirements, requests of law enforcement, or any dispute resolution process; (3) to avoid any liability, civil or criminal, on the part of Donuts, as well as its affiliates, subsidiaries, officers, directors, and employees; (4) per the terms of the registration agreement or (5) to correct mistakes made by Donuts or any Registrar in connection with a domain name registration. 

In accordance with our legal obligations, as the registry, they require the rectification and verification of registrant records relating to the domains. 

Kindly note for verification purpose, kindly provide us with the following documents:

- Government issued Photo ID proof of - Michael V. Razputko 

- 2 recent proofs of address (i.e. dated within the last 3 months) - Utility bills 

You are requested to provide us with the above-mentioned documents within 24hrs. As this pertains to a legal obligation of the Registry, we ask for an immediate response and action. Failure to do so shall lead to the suspension of your domain by the Registry.

As a US company, we are not permitted to provide services to or engage in any transactions with countries, regions, entities, or individuals targeted by applicable sanctions, whether directly or indirectly, unless authorized under applicable laws.

Specifically, the evidence noted includes the fact that the registrant information, provided by you, does indicate that you are a resident of UKRAINE:

In light of the above, we provided notification to your registrar on record PDR Ltd. d/b/a PublicDomainRegistry.com on 6/21/2022 advising them that in line with our legal obligations, the Registry required immediate rectification and verification of registrant records relating to the noted domain. We also informed them that failure to provide such confirmation and verification, would result in suspension. We can confirm that the registry did not receive any such response, confirmation or verification by the close of business, 6/23/2022. Therefore, as we advised your registrar, we have suspended the domain. For more details as to this matter, please contact your registrar to discuss this matter.

Arranging the release of the domain:

We can remove the suspension on the domain once we are satisfied that the registration of the noted domain was not made in contravention of the applicable legal obligations on us, as an entity which is subject to the laws of the US.

Given the nature of the data that has been noted, i.e. addresses that appear to be within sanctioned countries, we must insist that any updates meet the following additional verification requirements:

* Updated registrant information, where provided, must be verified as full and accurate.

* Updated registrant information must not indicate a continued connection to any sanctioned country.

* The Registry shall require enhanced verification from the registrant that, contrary to the evidence noted to date, that they are not a resident of a sanctioned country or regions. Such evidence should, at a minimum, include 1 form of formal identification and 2 recent proofs of address (i.e. dated within the last 3 months); such evidence must be provided to the registry for our records; OR

* Alternatively, should we receive sufficient confirmation of a US Department of the Treasury OFAC license which permits the relevant registrant to engage in the provision of services, or to engage in transactions in the relevant sanctioned country or regions, we shall accept this (this shall necessarily also require ID verification).

* We must also advise, given the records of the domain, the Registry will be obliged to perform enhanced due diligence to ensure all available evidence is considered. This will necessarily include the review of any resolving website associated with a listed domain. The presence of indicators e.g. an OFAC sanctioned country being listed as base of operations and/or where the site is engaged in the provision of services within a sanctioned country, this may also be considered in assessing any applicable US Sanctions.

NOTE: We recommend that you provide this verification data to your registrar at the earliest.
